TRAVEL SERVICES AGREEMENT & TERMS AND CONDITIONS

Effective Date: 10/19/2026

These Terms and Conditions ("Agreement") govern the relationship between Magical Adventure Travel, llc DBA Travel Genie Amanda ("Agency," "we," "our," or "us") and the client ("Traveler," "you," or "your").

By signing or electronically accepting your proposal, invoice, or booking documents, or by authorizing bookings, paying planning fees, paying supplier deposits, or approving itineraries, you acknowledge that you have read and agree to be bound by these Terms and Conditions.

1. OUR SERVICES

The Agency provides travel planning, consultation, itinerary design, supplier research, booking assistance, travel coordination, and related advisory services.

Our role is to use our professional expertise and industry relationships to assist in planning and arranging travel experiences that meet your goals and preferences.

We specialize in coordinating travel arrangements through third-party travel suppliers, including but not limited to airlines, hotels, resorts, cruise lines, tour operators, transportation providers, destination management companies, and travel insurance providers.

2. AGENCY RELATIONSHIP

The Agency acts solely as an independent intermediary between Travelers and travel suppliers ("Suppliers").

We do not own, operate, manage, supervise, control, or provide transportation, accommodations, tours, cruises, activities, insurance products, or other travel services.

All travel services are provided by independent Suppliers who maintain their own terms, conditions, policies, and procedures.

Your booking constitutes a separate contractual relationship between you and the applicable Supplier.

The Agency is not responsible for the acts, omissions, errors, bankruptcy, insolvency, negligence, or financial condition of any Supplier.

3. CLIENT RESPONSIBILITIES

You are responsible for:

  • Providing accurate traveler information.
  • Reviewing all travel documents immediately upon receipt.
  • Verifying names exactly match government-issued identification.
  • Meeting all passport, visa, vaccination, and entry requirements.
  • Complying with supplier rules and destination laws.
  • Purchasing travel insurance or knowingly declining coverage.

Failure to provide accurate information may result in denied boarding, denied entry, cancellation, supplier penalties, or additional costs for which the Agency shall not be responsible.

4. GROUP BOOKINGS

When making arrangements for multiple travelers, the individual making the booking represents that they have authority to act on behalf of all travelers included in the reservation.

The primary traveler is responsible for:

  • Distributing these Terms and Conditions.
  • Communicating booking information.
  • Coordinating payments.
  • Ensuring traveler information is accurate.

The Agency shall not be liable for any failure by the primary traveler to communicate information to members of their party.

5. PLANNING FEES AND PROFESSIONAL FEES

The Agency may charge planning, consultation, itinerary design, management, research, service, or professional fees.

Such fees compensate the Agency for time, expertise, supplier coordination, itinerary development, and consultation services.

Unless otherwise stated in writing:

  • Professional service fees are non-refundable.
  • Planning fees are non-refundable.
  • Consultation fees are non-refundable.
  • Service fees remain earned once work has commenced.

Cancellation of travel does not entitle the Traveler to a refund of Agency service fees.

In addition to any service fees, the Agency may receive commissions or other compensation from Suppliers in connection with the Traveler's booking

6. BOOKINGS AND PAYMENTS

Supplier deposits and final payments are governed by supplier requirements. Payment deadlines will be communicated in writing. Payments for airfare, accommodations, cruises, tours, and other travel services are charged directly by the applicable Supplier. The Agency does not collect or hold Traveler funds for Supplier services, and the Agency's service/consultation fees are billed separately.

Failure to submit payments by the required date may result in:

  • Cancellation of reservations;
  • Additional supplier penalties;
  • Loss of deposits;
  • Loss of promotional pricing; or
  • Complete cancellation of travel arrangements.

The Traveler assumes all responsibility for losses resulting from missed payment deadlines.

7. PRICING CHANGES

Pricing is guaranteed once the Supplier has confirmed the reservation and received the required deposit, except that Supplier-imposed taxes, fees, fuel surcharges, and similar charges may be passed through to the Traveler at any time before final payment.

Supplier pricing may fluctuate due to:

  • Currency exchange changes;
  • Fuel surcharges;
  • Taxes and government fees;
  • Transportation costs;
  • Resort fees;
  • Port fees;
  • Supplier pricing changes.

8. TRAVEL INSURANCE

The Agency strongly recommends comprehensive travel insurance for every trip.

Travel insurance may provide coverage for:

  • Trip cancellation;
  • Trip interruption;
  • Medical expenses;
  • Emergency evacuation;
  • Travel delays;
  • Baggage loss;
  • Supplier financial default.

The Agency may provide information about available travel insurance options but does not provide advice regarding specific coverage. Questions about coverage, exclusions, or claims should be directed to the insurance provider.

The Agency is not an insurance provider and cannot guarantee coverage under any insurance policy.

Travelers who decline travel insurance acknowledge that they may be personally responsible for financial losses arising from cancellation, interruption, illness, injury, weather events, supplier insolvency, government actions, or other unforeseen circumstances.

9. HEALTH REQUIREMENTS AND COMMUNICABLE DISEASES

Travel involves exposure to risks that may include illness, communicable diseases, injury, or other health-related events.

Health regulations, testing requirements, vaccination requirements, and entry restrictions may change before or during travel.

Travelers are solely responsible for:

  • Understanding current requirements;
  • Obtaining required vaccinations;
  • Meeting entry requirements;
  • Following destination health regulations.

The Agency shall not be responsible for losses resulting from denied boarding, denied entry, quarantines, testing requirements, border closures, or government-imposed restrictions.

10. PASSPORTS, VISAS, AND DOCUMENTATION

Travelers are solely responsible for obtaining:

  • Valid passports;
  • Required visas;
  • Entry permits;
  • Vaccinations;
  • Health documentation; and
  • Any other travel documentation required by applicable authorities.

The Agency is not responsible for denied boarding, denied entry, delays, cancellations, or additional costs caused by incomplete or invalid documentation.

11. CANCELLATIONS BY THE TRAVELER

Cancellation requests must be submitted in writing.

Supplier penalties and cancellation fees are governed by each Supplier's policies.

Agency planning, consultation, and professional service fees remain non-refundable.

Refund eligibility is determined solely by the applicable Supplier.

The Agency cannot guarantee refunds and is not responsible for a Supplier's refusal or inability to provide one.

12. CHANGES REQUESTED BY THE TRAVELER

Changes requested after confirmation may result in:

  • Agency service fees;
  • Supplier change fees;
  • Fare increases;
  • Loss of promotional pricing;
  • Additional travel costs.

All change fees are the responsibility of the Traveler.

13. CHANGES OR CANCELLATIONS BY SUPPLIERS

Travel Suppliers reserve the right to:

  • Modify itineraries;
  • Substitute accommodations;
  • Change schedules;
  • Adjust transportation;
  • Cancel reservations;
  • Alter services.

The Agency will assist with communication between Travelers and Suppliers but is not responsible for Supplier decisions.

14. FORCE MAJEURE

The Agency shall not be liable for delays, changes, interruptions, loss, damage, injury, or cancellation resulting from events outside our control including but not limited to:

  • Weather events;
  • Natural disasters;
  • Government actions;
  • War;
  • Civil unrest;
  • Strikes;
  • Supplier bankruptcy;
  • Public health emergencies;
  • Terrorism;
  • Transportation disruptions;
  • Border closures;
  • Power outages; or
  • Other unforeseen circumstances.

Any refunds remain subject to Supplier policies.

15. ASSUMPTION OF RISK

The Traveler acknowledges that travel involves inherent risks including but not limited to:

  • Transportation accidents;
  • Medical emergencies;
  • Crime;
  • Injury;
  • Illness;
  • Weather events;
  • Political instability;
  • Acts of third parties.

The Traveler voluntarily assumes all risks associated with travel and participation in booked activities.

16. LIMITATION OF LIABILITY

Except for claims arising from the Agency's gross negligence or willful misconduct, the Agency's total liability for any claim arising out of or relating to this Agreement, including claims based on the Agency's own negligence, shall not exceed the total service fees paid by the Traveler to the Agency for the booking giving rise to the claim. In no event shall the Agency be liable for any indirect, incidental, consequential, or punitive damages.

The Agency is not responsible for acts or omissions of Suppliers.

17. CHARGEBACKS

By authorizing any payment, the Traveler confirms the charges are valid and authorized.

The Traveler agrees to attempt resolution directly with the Agency before initiating any chargeback dispute.

Chargebacks relating to validly authorized payments, non-refundable deposits, supplier penalties, or disclosed cancellation policies may be disputed and recovered by the Agency to the fullest extent permitted by law.

If the Traveler initiates a chargeback of any Agency service fee that is resolved in the Agency's favor, the Traveler agrees to reimburse the Agency for all chargeback fees, collection costs, and reasonable attorney fees incurred.

18. DISPUTE RESOLUTION AND GOVERNING LAW

This Agreement shall be governed by the laws of the State of Colorado without regard to conflict of law principles.

Any disputes arising from this Agreement shall be brought exclusively to the state courts located in Arapahoe County, Colorado, or the United States District Court for the District of Colorado, where the Agency maintains its principal place of business.

The parties consent to the jurisdiction of those courts.

19. CLASS ACTION WAIVER

To the fullest extent permitted by law, claims against the Agency may be brought only in an individual capacity.

Neither party shall participate in any class action, mass action, representative action, or collective proceeding against the other.

20. SEVERABILITY

If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect.

21. ENTIRE AGREEMENT

These Terms and Conditions, together with any invoices, itineraries, booking confirmations, supplier terms, waivers, and travel documents supplied by the Agency, constitute the entire agreement between the parties. In the event of a conflict, these Terms and Conditions control over any invoice or itinerary, and Supplier terms control only as to the Supplier's own services.

22. TERMINATION BY THE AGENCY

The Agency may suspend or terminate this Agreement and its services, effective upon written notice to the Traveler, if:

  • The Traveler fails to pay any Agency fee when due;
  • The Traveler, or any member of the Traveler’s party, engages in abusive, threatening, harassing, discriminatory, or otherwise unreasonably hostile conduct toward the Agency, its personnel, or any Supplier;
  • The Traveler provides false or misleading information, or attempts to make a fraudulent or unauthorized payment;
  • The Traveler initiates a chargeback without first attempting resolution with the Agency as required by Section 17; or
  • The Traveler repeatedly fails to cooperate in a way that prevents the Agency from reasonably performing its services.

The Traveler may also end the relationship at any time by written notice to the Agency, subject to Section 11.

Effect of termination. Upon termination by either party:

  • Agency planning, consultation, and professional service fees that have been earned for work performed through the termination date remain earned and non-refundable, as provided in Section 5, and any earned but unpaid fees become immediately due.
  • If the Agency terminates for reasons other than the Traveler’s breach, the Agency will refund any prepaid service fees for work not yet performed.
  • Payments made to Suppliers are governed by each Supplier’s terms and cancellation policies. The Agency does not hold Supplier funds and is not responsible for refunding them. The Traveler remains responsible for all Supplier penalties, cancellation fees, and change fees.
  • The Agency may cancel any unconfirmed holds or pending reservations. At its discretion, and where the Supplier permits, the Agency may assist in transferring existing bookings to the Traveler or another advisor. The Agency may charge a reasonable transition fee for this assistance.
  • The Agency shall not be liable for any loss, cost, or inconvenience resulting from a termination made in accordance with this Section.

23. PRIVACY AND SHARING OF TRAVELER INFORMATION

The Agency collects and uses personal information as described in its Privacy Policy, available at https://travelgenieamanda.com/privacypolicy2026 which is incorporated into this Agreement by reference.

By accepting this Agreement, the Traveler consents to the Agency collecting, using, and sharing traveler information, including names, passport and identification details, dates of birth, contact information, payment-related details, and health, dietary, or accessibility needs, with Suppliers and other third parties as needed to research, quote, book, modify, or service the Traveler’s arrangements.

The Traveler understands that once information is provided to a Supplier, the Supplier’s own privacy policies and practices apply, and the Agency is not responsible for how Suppliers use, store, or protect that information.

The Traveler represents that they have the authority to provide this information, and to give this consent, on behalf of every member of their party, including any minors. Under Section 4, the primary traveler is responsible for informing all travelers of this Section.

24. PHOTO AND TESTIMONIAL CONSENT

Unless the Traveler notifies the Agency otherwise in writing, the Traveler grants the Agency permission to use, without compensation, photographs, videos, reviews, and testimonials that the Traveler provides or authorizes (including content tagged to the Agency), along with the Traveler’s first name and general travel destination, on the Agency’s website, social media, and marketing materials.

  • The Agency will not publish the Traveler’s full name, home address, travel dates before or during travel, or other sensitive personal information without separate written permission.
  • The Traveler may withdraw this consent at any time by written notice. Withdrawal applies to future use only. The Agency is not required to remove materials already published or printed, but will make reasonable efforts to remove them from online accounts it controls.
  • The Traveler represents that they have the right to grant this permission for any content they submit and for any member of their party included in it. Permission for minors must be given by a parent or legal guardian.

25. ELECTRONIC COMMUNICATIONS AND “IN WRITING”

The Traveler consents to receive communications from the Agency by email and text message (SMS) at the contact details provided, including itineraries, payment reminders, booking confirmations, travel updates, and service-related messages. Message and data rates may apply. The Traveler may opt out of text messages at any time by replying STOP, though this may limit the Agency’s ability to deliver time-sensitive travel information. Consent to receive marketing messages is separate, optional, and not a condition of using the Agency’s services.

As used in this Agreement, “in writing” and “written” include email and electronic documents. Text messages and social media messages do not satisfy any requirement that a notice, cancellation, or change request be made in writing unless the Agency confirms it by email.

The Traveler agrees that electronic signatures and electronic acceptance of this Agreement, proposals, and invoices are valid and legally binding to the same extent as handwritten signatures.

26. SPECIAL REQUESTS AND ACCESSIBILITY ACCOMMODATIONS

The Agency will pass along the Traveler’s special requests, including room preferences, dietary needs, celebrations, and accessibility or mobility accommodations, to the applicable Suppliers. All such requests are subject to availability and Supplier approval and are not guaranteed.

  • Accessibility and amenity information is provided by Suppliers. The Agency cannot independently verify it and is not responsible for inaccuracies.
  • Travelers who require accessibility, medical, or dietary accommodations should disclose them in writing at the time of booking and should confirm the arrangements directly with each Supplier before travel.
  • The Agency is not liable if a Supplier fails to honor, or declines to provide, any request or accommodation.
  • Nothing in this Section limits any rights the Traveler may have under applicable disability-access laws.

27. NOTICES

Notices to the Agency must be sent in writing by email to Amanda.scout@genietravelco.com and/or by mail (7584 S Ogden Way, Centennial, CO 80122). Notices to the Traveler will be sent to the email address or mailing address provided at booking. The Traveler is responsible for keeping contact information current and for monitoring email, including spam and junk folders.

An emailed notice is considered received on the next business day after it is sent, unless the sender receives a delivery failure message. A mailed notice is considered received [three (3)] business days after mailing.

28. AMENDMENTS

The Agency may update these Terms and Conditions from time to time. Updated terms will be provided or made available to the Traveler and will apply only to bookings, proposals, or services accepted by the Traveler after the effective date of the update. Bookings accepted before that date remain governed by the terms in effect when they were accepted. Any change to the terms of an existing agreement with a specific Traveler must be made in writing and agreed to by both parties.

29. SURVIVAL

Termination or expiration of this Agreement does not affect any rights or obligations that have accrued before termination or that by their nature are intended to continue. These include, without limitation: Section 5 (Planning Fees), payment obligations under Section 6, Section 11 (Cancellations), Sections 15 and 16 (Assumption of Risk; Limitation of Liability), Section 17 (Chargebacks), Sections 18-21 (Dispute Resolution; Class Action Waiver; Severability; Entire Agreement), the effects of termination under Section 22, Section 23 (Privacy), Section 24 as to materials already published, and Section 27 (Notices).
