Travel Genie Amanda · travelgenieamanda.com
Effective Date: 10/29/2026
Welcome to travelgenieamanda.com (the “Website”). The Website is operated by Magical Adventure Travel, LLC, doing business as Travel Genie Amanda (“Company,” “we,” “our,” or “us”), a Colorado travel advisory business with its principal place of business in Arapahoe County, Colorado.
These Website Terms and Conditions (“Terms”) govern your access to and use of the Website and any content, tools, forms, and features offered through it. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.
1. Who We Are and What This Website Is
We provide travel planning, consultation, itinerary design, supplier research, booking assistance, and related advisory services. The Website is intended to share information about our services, inspire travel ideas, and allow you to contact us or request a consultation.
We act solely as an independent intermediary between travelers and third-party travel suppliers, such as airlines, hotels, resorts, cruise lines, tour operators, transportation providers, destination management companies, and travel insurance providers (“Suppliers”). We do not own, operate, manage, or control any Supplier or provide the transportation, lodging, tours, cruises, activities, or insurance products they offer.
2. Relationship to Our Travel Services Agreement
Using the Website, browsing our content, or submitting an inquiry does not create a booking, a client relationship, or an obligation for us to provide planning services.
Our planning services and travel bookings are governed by a separate Travel Services Agreement & Terms and Conditions that you will receive and accept before we begin work or make any booking on your behalf (the “Travel Services Agreement”). That agreement covers planning fees, payments, cancellations, changes, supplier relationships, and related matters.
These Terms govern only your use of the Website. If you become a client, and there is a conflict between these Terms and the Travel Services Agreement concerning our travel services, the Travel Services Agreement controls. These Terms continue to apply to your use of the Website itself.
3. Eligibility
You must be at least 18 years old to use the Website to submit inquiries or request services. The Website is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us personal information, please contact us so we can delete it.
If you use the Website on behalf of a family, group, or organization, you represent that you have the authority to do so.
4. Informational Content Only; No Professional Advice
Content on the Website, including blog posts, destination guides, sample itineraries, social media content, and recommendations, is provided for general informational and inspirational purposes only. It is not a substitute for personalized advice from us under a Travel Services Agreement, and it is not legal, medical, tax, immigration, financial, or insurance advice.
Travel conditions change quickly. Entry requirements, visas, vaccinations, health advisories, safety conditions, weather, hours, and prices may change without notice. You are responsible for verifying current requirements and conditions before you travel, including by checking official sources such as the U.S. Department of State (travel.state.gov) and the Centers for Disease Control and Prevention (cdc.gov/travel), as well as directly with the relevant Suppliers and authorities.
Sample itineraries and recommendations are examples only. They are not offers, and availability and pricing are not guaranteed.
5. Pricing, Availability, and Supplier Information
Prices, rates, promotions, descriptions, photographs, ratings, amenities, accessibility details, and availability shown on the Website may come from Suppliers or other third parties. We work to keep information accurate, but we cannot independently verify all of it, and errors, omissions, and changes can occur.
Nothing on the Website is a binding offer or a guarantee of price or availability. Pricing and availability are confirmed only when a Supplier confirms a reservation and you have accepted the applicable Travel Services Agreement and any Supplier terms. Supplier-imposed taxes, fees, and surcharges may change as described in your Travel Services Agreement.
We reserve the right to correct errors, inaccuracies, or omissions on the Website at any time without prior notice.
6. Third-Party Suppliers, Content, and Links
The Website may contain links to, or embedded content from, Suppliers, booking portals, insurance providers, social media platforms, and other third-party sites. We do not control these sites and are not responsible for their content, availability, policies, or practices. A link does not mean that we endorse a third party or guarantee its products or services.
Any purchase from, or agreement with, a Supplier or other third party is a separate relationship between you and that party and is governed by its own terms and privacy policy. We are not responsible for the acts, omissions, errors, financial condition, or insolvency of any Supplier.
7. Commissions and Compensation Disclosure
We may be compensated for our services through planning or consultation fees charged to you, and through commissions, referral fees, or other compensation paid by Suppliers or affiliate programs when travel is booked through us or through links on the Website. This compensation generally does not increase the price you pay for Supplier services. We strive to recommend options that fit your goals and preferences, and we will answer questions about how we are compensated on request.
8. Inquiries, Forms, and Communications
When you submit an inquiry, consultation request, or other form through the Website, you agree to provide accurate and complete information and to keep it current.
By providing your email address or phone number, you agree that we may contact you by email, phone, or text message (SMS) to respond to your inquiry and to provide service-related communications. Message and data rates may apply. You may opt out of text messages at any time by replying STOP, and you may opt out of emails using the unsubscribe link in any email.
Marketing messages are separate and optional. Consent to receive marketing messages is not required to use the Website or to receive our services, and we will honor your opt-out choices.
Submitting an inquiry is not a request for, or acceptance of, any booking. Please do not submit sensitive information, such as passport numbers, payment card numbers, or health information, through general website contact forms or by unsecured email. We will tell you how to provide that information securely when it is needed for a booking.
9. Acceptable Use
You agree to use the Website only for lawful purposes and in accordance with these Terms. You agree not to:
10. Reviews, Photos, and Content You Submit
The Website and our social media accounts may allow you to submit or tag reviews, testimonials, photographs, videos, comments, or other materials (“User Content”). You keep ownership of your User Content.
By submitting User Content to us, or by tagging or sharing it with us in a way that invites us to use it, you grant us a non-exclusive, worldwide, royalty-free, license to use, reproduce, display, and distribute it on the Website, our social media, and our marketing materials, along with your first name and general travel destination, unless you notify us in writing that you do not want us to. We will not publish your full name, home address, travel dates before or during travel, or other sensitive personal information without your separate written permission.
You may withdraw this permission at any time by written notice to us. Withdrawal applies to future use only. We are not required to remove materials already published or printed, but we will make reasonable efforts to remove them from online accounts we control.
You represent that you own or have the right to grant this permission for all User Content you submit, including for any person who appears in it. Permission for any minor must be given by a parent or legal guardian. We may remove any User Content that we believe in good faith is unlawful, inaccurate, offensive, or infringing.
11. Intellectual Property
The Website and its content, including text, graphics, logos, the Travel Genie Amanda name and branding, images, itineraries, layout, and design, are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws. Content provided by Suppliers and other third parties belongs to them.
You may view and print Website content for your own personal, non-commercial use, provided you keep all copyright and other notices intact. You may not copy, reproduce, modify, distribute, republish, sell, or create derivative works from our content, or use our name or logos, without our prior written permission.
If you believe content on the Website infringes your copyright, please send a written notice to the contact address below that identifies the work and the allegedly infringing material and includes your contact information, and we will review it promptly.
12. Privacy and Cookies
Our collection and use of personal information is described in our Privacy Policy, available at https://travelgenieamanda.com/privacypolicy2026, which is incorporated into these Terms by reference. Your acceptance of these Terms is separate from, and is not a substitute for, any consent that applicable privacy law requires us to obtain for specific uses of your personal information. Where the law gives you privacy rights, such as rights to access, correct, delete, or opt out, the Privacy Policy explains how to exercise them.
The Website may use cookies, analytics tools, and similar technologies to operate, understand how the Website is used, and improve your experience. Details, including how to manage your preferences, are in the Privacy Policy.
13. Accessibility
We want the Website to be usable by everyone. If you have difficulty accessing any part of the Website or its content, please contact us using the information below and we will work with you to provide the information in another way. Nothing in these Terms limits any rights you may have under applicable disability-access laws.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the Website and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Website will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Website or its servers are free of viruses or other harmful components.
15. Limitation of Liability
To the fullest extent permitted by law, and except for claims arising from our gross negligence or willful misconduct, we, and our owners, members, employees, and contractors, will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of, or inability to use, the Website or any content, links, or Suppliers referenced on it.
Except as stated above, our total liability for any claim arising out of or relating to the Website or these Terms will not exceed one hundred dollars ($100). Liability for our travel services is governed by the Travel Services Agreement.
Some laws do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under Colorado or other applicable law, or any rights you have under the Colorado Consumer Protection Act.
16. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless the Company and its owners, members, employees, and contractors from claims, losses, liabilities, and reasonable expenses, including reasonable attorney fees, arising out of your violation of these Terms, your misuse of the Website, your User Content, or your violation of any law or third party’s rights.
17. Governing Law and Venue
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Website must be brought exclusively in the state courts located in Arapahoe County, Colorado, or the United States District Court for the District of Colorado, and you consent to the personal jurisdiction of and venue in those courts.
Before filing any claim, you agree to first contact us and make a good-faith effort to resolve the dispute informally for at least thirty (30) days.
18. Class Action Waiver
To the fullest extent permitted by law, any claim relating to these Terms or the Website may be brought only in an individual capacity. Neither you nor we may participate in a class action, mass action, representative action, or collective proceeding against the other.
19. Suspension of Access
We may suspend or restrict your access to the Website at any time, with or without notice, if we believe you have violated these Terms or applicable law, or if necessary to protect the Website, our business, or others. We may also modify, suspend, or discontinue any part of the Website at any time.
20. Changes to These Terms
We may update these Terms from time to time. The updated Terms will be posted on this page with a new effective date and apply from that date. Your continued use of the Website after an update means you accept the updated Terms. Updates to these Terms do not change a Travel Services Agreement you have already accepted; changes to that agreement require a writing agreed to by both parties as stated in it.
21. Electronic Communications and Notices
You consent to receive notices and other communications from us electronically, including by email and by posting on the Website, and agree that these satisfy any legal requirement that communications be in writing. Notices to us must be sent by email to the address below. An emailed notice is considered received on the next business day after it is sent, unless the sender receives a delivery failure message. You are responsible for keeping your contact information current.
22. General Provisions
Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Entire Agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding your use of the Website. They do not replace any Travel Services Agreement.
Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a sale, merger, or reorganization of our business, or a change in our business name or branding.
Survival. Provisions that by their nature should survive, including those on intellectual property, User Content licenses, disclaimers, limitation of liability, indemnification, governing law, and the class action waiver, survive any termination of your use of the Website.
